The Power House Gym Terms & Conditions
MEMBERSHIP ACCEPTANCE & ACCESS
The Power House reserves the right to verify, or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation.
Upon acceptance of the member, a finger print scan will be set up to allow access to the gym. Along with the finger print scan all members will be issued with their own QR code which is assigned to each member on the beginning of their contract.
The barcode can be accessed on any Smart Phone via the ClubRight app. The QR code must be scanned every time entering the gym, failure to do so can result in termination of the membership.
The lending of your QR code or giving access to the facility to non-member will void your membership immediately, a 12-month ban will be imposed on your usage and no refund will be given.
Person under the age of 16 is allowed within the gym under supervision of a parent or guardian. Person between the ages of 16-18 must have a written letter (Parental/Guardian Consent Form) from a parent or guardian granting permission to use the gym.
LIMITATION OF LIABILITY
The member is responsible for the consequences of any use of any of the facilities of the gym. The gym will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.
PHYSICAL HEALTH OF MEMBER
The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition, the member acknowledges and has read and agrees with the PARQ form upon signing membership. The member acknowledges that they understand that they are responsible for their own well-being and safety.
In the event that I am injured or my property is damaged, I will bring no claim, legal or otherwise, against The Power House in respect of that injury or damage.
Member is aware and agree to purchase a membership at a facility that allows access 24/7
As such member is aware that there will be no supervision or assistance and also you are aware that if you are injured, become unconscious, suffer a stroke or heart attack, that there will likely be no one to respond to your emergency and the gym has no duty to provide assistance to you. Even though the gym is equipped with CCTV cameras, it is likely that should you require immediate assistance, none will be provided. STRONGLY RECOMMEND you have a workout partner accompany you through none supervised periods while The Power House gym 24/7, but is entirely is up to you.
GYM, EQUIPMENT, CLOTHING
All Equipment must be handle appropriately and return to designed location after use. PLEASE DO NOT DROP THE WEIGHTS. Any faults or damage of equipment must be reported to the staff of The Power House.
I acknowledge and agree that my use of the services, facilities, equipment or apparatus of the Gym will be undertaken under my own risk.
Personal belongings such as bags or other items must be stored in the shelves provided.
Enclose shoes must be worn all the time.
We recommend warm up and stretch before commencing your workout, and cool down and stretch upon competition of your workout.
An induction is available free as part of the membership for all new members, the member has the choice to opt out of the induction at their own risk. In the event the member does not organise and attend an induction with the gym, this will be deemed to be their confirmation that they have opted out of having an induction and are fully confident about using the equipment safely and as the manufacturer designed the equipment for.
MEMBERSHIP CHARGES, PAYMENT OPTIONS
Memberships are not refundable or transferrable after signing membership, without providing a cause or reason.
Promotional Rates: from time to time the site may offer a promotional rate, the promotional rate will run as per the promotion terms and conditions at the time of the promotional offer was made.
Members may elect to pay their membership fees by direct debit, card or cash.
The Power House gym reserves the right to increase Membership fees on a yearly basis.
If the member is on a Month to Month membership, the member can cancel their direct debit directly with the bank and this will automatically cancel their membership as at the end of the month in which they have cancelled their direct debit.
Prices displayed at the gym reception and on ClubRight at all times in relation to orders placed online.
EXPULSION OF MEMBERS OR TERMINATION OF MEMBERSHIP BY THE POWER HOUSE
The Power House may expel members or may terminate the membership of any member without notice and with immediate effect if the member's conduct, whether or not such conduct is the subject of a complaint by another member or group of members, and is such that in the reasonable opinion of the gym, it may be injurious to the character, name or interests of the gym or is such that it renders the member unfit to associate with other members of the gym or is such that it is not appropriate for the member to continue their membership or the member's behaviour is in the reasonable opinion of the gym to be inappropriate and / or unacceptable.
No smoking or vaping, is permitted in the gym
GYM FACILITIES
The Power House reserves the right to make reasonable alterations to the type of facilities provided without notice and The Power House shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services that occur for 14 days or less, due to matters beyond our control or improvement works.
The Power House reserves the right to change or remove any of the facilities at the gym. In such an event notice will be given.
FIRE EVACUATIONS
In case of fire:
Leave the building by the nearest exit.
Do not stop or return to collect personal belongings.
Go to the assembly point - the car park and remain there.
Return to the building only when authorised to do so by the Gym Manager.
THIRD PARTY RIGHTS
A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.
USE OF PERSONAL INFORMATION
We use the personal and transactional information (e.g. name, address, email address, phone number) ("Personal Information") you supply to us in order to fulfil your order. The lawful basis for this data processing while your membership is active is Contract. The lawful basis for the processing if your membership is cancelled or lapses is Legitimate Business Interest.
UNAUTHORISED ACCESS TO PERSONAL INFORMATION
Unless a member of our staff has been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorised access by a third party to the information (including in particular credit/debit card details) you transmit when you place an order. It is your responsibility to ensure the security of your own credit/debit card details to avoid unauthorised use.
I AGREE TO COMPLY WITH ALL RULES, CONDITIONS AND DIRECTIONS STIPULATED IN THIS TERMS AND CONDITIONS DOCUMENT REGARDING THE FACILITY AND ITS EQUIPMENT USE AND PERSONAL BEHAVIOUR OF MEMBERS WITHLIST USING THE GYM.
Should any part of this agreement be found by a court of a low to be against public policy or in violation of any state statute or case precedence, then only that wording is removed and the remainder of this agreement will remain in full force.
